a. In order to access certain elements of the Services, such as the ability to "claim your business listing," you must first create an account. Our Privacy Policy governs how we use any personal information you give us while creating an account. You are completely responsible for preserving the security and confidentiality of your account, as well as for any modifications or updates made through it and any activity related to it. You also need to keep your password private.

b. By using your login information from certain third-party social networking sites, you might also be able to register to utilise the Services (e.g., Facebook). By providing us with your social network login credentials, you attest that you are the legitimate owner of any such account. You give us permission to gather the authentication data you provide as well as any other data that could be accessible on or via your social media account in accordance with any applicable settings and guidelines.

c. You guarantee to us that any information you give to us throughout the account creation and/or business listing claim process is true, accurate, and correct, and that you will update it as needed to maintain its accuracy. Unless otherwise permitted by us, you are not permitted to create multiple accounts or business listings, impersonate someone else, create or use an account for someone other than yourself, provide an email address other than your own, create multiple accounts, or use false information to gain access to a business listing on the Services that you are not legally entitled to. You understand that any fraudulent claim of a company listing could result in significant financial losses and damages for Hello Super APP or other parties, for which you could be held responsible.

d. Additionally, you bear accountability for all actions taken within your account. In order for us to take the required corrective action in the event of any unauthorised use of your account, you undertake to tell us right away. Additionally, you commit to keeping your Hello Super APP account private and accepting responsibility for any unauthorised access that occurs.

e. You consent to receive certain communications related to the Hello Super APP Platform or Services by creating an account. For instance, other customers may leave you comments or may keep track of what you do on your account. Through account settings, you can modify or opt out of receiving non-essential communications.

Others Terms

a. We offer value-added telephonic services through our phone lines, which connect straight to restaurant phone lines and are visible on the particular restaurant listing page on the Hello Super APP Platform, in order to connect you to specific restaurants. We keep a record of everything related to this call, including the audio recording of your chat with the restaurant (for internal billing monitoring purposes and restaurant-side customer service enhancement). Please do not use Hello Super APP's phone services if you do not want your information to be recorded in this way. When you use the phone services on the Hello Super APP Platform via the phone lines that Hello Super APP provides, you expressly consent and authorise Hello Super APP to record all of this information.

b. You acknowledge and agree that you will only use the Services for what is authorised by (a) the Terms and (b) any applicable legislation, rule, or standard operating procedure in the relevant jurisdictions.

c. Except for the purposes of using 'Claim Your Business Listing' access, you undertake to use Hello Super APP's data (whether accessible through the Services or through other channels such APIs) only for personal use and not for any commercial use, unless both Hello Super APP and you have agreed in writing.

d. Unless you have received express permission to do so through a separate agreement with Hello Super APP, you agree not to access (or attempt to access) any of the Services by any means other than the interface that Hello Super APP provides. You specifically agree to follow the guidelines in any robots.txt file that may be present on the Services and to refrain from accessing (or attempting to access) any of the Services using automated means, including the use of scripts or web crawlers.

e. By using the Services, you consent to refrain from any conduct that modifies or interferes with them (or the systems and networks that are connected to the Services). You will not engage in spamming, which includes, but is not limited to, any unsolicited emailing, posting, or message, nor will you remove or alter any content or information posted by any other customer(s).


Ownership of Hello Super APP Content and Proprietary Rights

a. The Services and our Content are exclusively owned by us under copyright. The copyrights, trademarks, service marks, logos, trade names, trade dress, and other intellectual and proprietary rights related to the Hello Super APP Content and the Services are also exclusively owned by us (collectively, the "IP Rights"). These rights may be shielded by copyright, patents, trademarks, and other relevant intellectual property and proprietary rights and laws. You understand that the Services are original works that have been created, assembled, edited, revised, chosen, and organised by us and other parties using techniques and standards of judgement that have been developed and applied after investing a significant amount of time, money, and effort. You also understand that these materials are our and those parties' valuable intellectual property. You also agree that Hello Super APP may designate certain information as secret and that you will not release such information without first obtaining Hello Super APP's written consent.

b. During and after the term of this agreement, you agree to protect Hello Super APP's proprietary rights and the proprietary rights of everyone else with rights in the Services. You also agree to abide by any reasonable written requests from us, our suppliers, and content licensors in order to preserve their contractual, statutory, and common law rights in the Services, as well as the rights of others. All legal rights, title, and interest in and to the Services, including any intellectual property rights that may exist in the Services (regardless of whether such rights are registered or not, and wherever in the world they may exist), are acknowledged and agreed to be owned by Hello Super APP (or Hello Super APP's licensors). You also agree that Hello Super APP may designate certain information as secret and that you will not release such information without first obtaining Hello Super APP's written consent. Nothing in the Terms grants you permission to use any of Hello Super APP's trade names, trademarks, service marks, logos, domain names, or other distinguishing brand elements, unless you and Hello Super APP have agreed otherwise in writing.

c. You also agree not to remove, hide, or obliterate any copyright or other proprietary notice or source identifier, including without limitation the size, colour, location, or style of any proprietary mark(s). Furthermore, you agree not to use any framing techniques to enclose any trademark logo or other proprietary information of Hello Super APP. Any violation will result in appropriate legal action being taken against you in a suitable court to pursue all available and appropriate remedies under the applicable laws of the nation where the violation occurred. No portion of the Hello Super APP may be altered, duplicated, publicly displayed, or used for any other purpose without the full permission of Hello Super APP.

d. We neither guarantee nor make any representation that your use of the content on the Services won't violate the rights of unaffiliated or third-party entities, to the maximum degree allowed by relevant law. You undertake to promptly notify us, by following the directions in section XVI below, of any claim that the Services violate any copyright, trademark, or other contractual, intellectual, statutory, or common law rights.

Your License to Hello Super APP Content

Only personal, non-commercial use of the information made available through the Services is permitted. Hello Super APP License to Your or Customer Content

You hereby irrevocably grant Hello Super APP a perpetual, irrevocable, worldwide, non-exclusive, fully paid and royalty-free, assignable, sub-licensable, and transferable licence and right to use Your Content (including content shared by any business user with access to a "restaurant business page" to manage claimed business listings or otherwise) and all intellectual property rights therein for any purpose, including partnerships with third parties through APIs, in any media now in existence or in future. What we mean by "use" is to make use of, duplicate, show, disseminate, alter, translate, reformat, incorporate into ads and other works, analyse, market, advertise, produce derivative works, and, in the case of third-party services, let users and others to reproduce. By submitting your name or username, you give us permission to use it in connection with Your Content. Any claims and assertions of moral rights or attribution over Your Content made against Hello Super APP or its Customers, any third-party services and their users are hereby irrevocably waived and caused to be renounced.

Representations Regarding Your or Customer Content

a. Your Content is your responsibility. You guarantee and represent that: Your Content was not submitted through the use of any automated process, such as a script bot; use of Your Content by us, third party services, and our and any third party users will not violate or infringe any rights of yours or any third party; Your Content was not copied from or based in whole or in part on any other content, work, or website; and You are the only author, owner, and/or authorised user of Your Content. and Neither the Guidelines and Policies nor any relevant laws are broken by Your Content.

b. If Your Content is a review, you guarantee and represent that you are the only author of the review; that the review is an accurate account of your actual dining experience; that you were not compensated in any way for writing the review or posting it; and that you had no personal, financial, or competitive incentive to write or post a review that wasn't a fair representation of your honest opinion.

c. You take entire responsibility for any risks relating to Your Content, including the possibility that someone will rely on its authenticity, correctness, or dependability, or that you will reveal personally identifiable information in Your Content. Although we have the right to remove Content, we have no control over activities or content provided by our customers, and we cannot ensure that any Content is accurate, reliable, or of high quality. You understand and accept that Hello Super APP is not responsible for any Content provided by customers, and that the customer posting the content bears all liability.

Content Removal

We reserve the right, in our sole discretion, to remove, block, or deactivate access to any Content that we deem objectionable, in violation of the Terms, or otherwise detrimental to the Services or our Customers, at any time and without prior notice. We shall not be under any obligation to return any of Your Content to you, save from the requirements of relevant law. Furthermore, at its sole discretion, the Restaurant retains the right to remove any photos and pictures that are a part of Customer Content from that Restaurant's listing page.

Third-Party Content and Links

a. Certain content accessible via the Services might contain or contain links to content owned by third parties, like third-party dining establishments, food delivery/ordering services, and reservation services. Please be aware that the terms of service and privacy policies that apply to the relevant third party will control your usage of such third-party services. Business addresses, phone numbers, and other contact details may be provided to us by outside vendors whose data is sourced from open sources.

b. Regarding any product, service, advertisement, or other content that appears in or is linked to from the Services, we have no control over it and neither do we make any representations or endorsements regarding its correctness, relevancy, copyright compliance, legality, completeness, timeliness, or quality. Before or after adding third-party content to our services, we don't inspect or look into it.

c. We reserve the right to edit, add to, or remove any errors or omissions from any part of the content available on the Services at our sole discretion and without being under any legal pressure. Any updates, alterations, or changes to any content available on the Services may be verified by us at any time, at our absolute discretion and without any obligation. However, we will not be held responsible for any delays or errors resulting from such updates. Regarding any of Your Content or other content from third parties, we neither guarantee nor accept liability.

e. Furthermore, you acknowledge and agree that Hello Super APP is not responsible for any loss or damage you may suffer as a result of those external sites or resources being available to you or as a result of your reliance on the existence, completeness, or accuracy of any advertising, products, or other materials on such websites or resources. We specifically disclaim any liability for any offensive, defamatory, unlawful, intrusive, unfair, or infringing content provided by third parties, without limiting the generality of the aforementioned.

Customer Reviews

a. The Hello Super APP does not endorse any restaurant based on reviews or ratings left by customers. Numerous customer reviews and ratings for restaurants are received by Hello Super APP, and these reviews and ratings represent the opinions of the customers. It is important to note that all reviews on Hello Super APP represent the customer's or reviewer's personal opinion alone. With access to the restaurant business page, Hello Super APP is a neutral platform that only serves as a channel of communication for customers and reviews, including customers and restaurant owners and representatives. The reviews that these advertisers receive have no bearing on the adverts that are posted on the Hello Super APP Platform.

b. The best course of action for the restaurant representative would be to get in touch with the reviewer or publish a public comment to clear up any misunderstandings, but since we are an impartial platform, we are unable to mediate disputes. Should the restaurant feel that a certain customer's review breaches any Hello Super APP standards, they can contact us via email at hellovillagesuperapp@gmail.com to report the violation. If the review is detrimental to the Services in any way or breaches the Terms, content guidelines, or policies, Hello Super APP has the right, at its sole discretion, to remove it.

d. Contains material that violates the standards of good taste or the standards of the Services;

e. violates any third-party rights, such as the rights to publicity, privacy, or intellectual property, including but not limited to copyright, trademarks, patents, trade secrets, and others;

f. Accuses others of illegal activity, or describes physical confrontations;

h. Is illegal, or violates any federal, state, or local law or regulation (for example, by disclosing or trading on inside information in violation of securities law);

i. Attempts to impersonate another person or entity;

j. Disguises or attempts to disguise the origin of Your Content, including but not limited to

(i) submitting Your Content under a false name or false pretences, or
(ii) disguising or attempting to disguise the IP address from which Your Content is submitted;

k. Constitutes a form of deceptive advertisement or causes, or is a result of, a conflict of interest;

l. Is commercial, encompassing, but not restricted to, spam, polls, competitions, pyramid schemes, postings or reviews removed or submitted in exchange for money, postings or reviews withdrawn or submitted at the business under review's request, or other promotional materials;

m. Asserts or implies that Your Content is in any way sponsored or endorsed by us;

n. Contains material that is not in English or, in the case of products or services provided in foreign languages, the language relevant to such products or services;

o. Falsely states, misrepresents, or conceals your affiliation with another person or entity;

p. Accesses or uses the account of another customer without permission;

q. Distributes computer viruses or other code, files, or programs that interrupt, destroy, or limit the functionality of any computer software hardware or electronic communications equipment;

r. Interferes with, disrupts, or destroys the functionality or use of any features of the Services or the servers or networks connected to the Services;

s. "Hacks" or accesses without permission our proprietary or confidential records, records of another Customer, or those of anyone else;

t. Violates any contract or fiduciary relationship (for example, by disclosing proprietary or confidential information of your employer or client in breach of any employment, consulting, or non-disclosure agreement);

u. Decompiles, reverse engineers, disassembles or otherwise attempts to derive source code from the Services;

v. Removes, circumvents, disables, damages or otherwise interferes with security-related features or features that enforce limitations on the use of, the Services;

w. Violates the restrictions in any robot exclusion headers on the Services, if any, or bypasses or circumvents other measures employed to prevent or limit access to the Services;

x. Collects, accesses, or stores personal information about other Customers of the Services;

y. Is posted by a bot;

z. Harms minors in any way;
aa. endangers public order, cordial relations with foreign nations, the defence, security, or sovereignty of India or the nation in question, or it incites the commission of crimes that are punishable by law, obstructs the investigation of crimes, or disparages another country;
ab. Modifies, copies, scrapes or crawls, displays, publishes, licenses, sells, rents, leases, lends, transfers or otherwise commercializes any rights to the Services or Our Content; or
ac. Attempts to do any of the foregoing.

Nonetheless, we reserve the right to take such action in order to manage and enhance the Services (including, but not limited to, fraud prevention, risk assessment, investigation, and customer support purposes), to make sure you abide by the Terms, and to comply with any applicable laws, orders, decrees, administrative agencies, or other governmental bodies.

By using the Hello Super APP Platform and Services, you promise Hello Super APP that you will only use them for legal purposes and that you won't break any applicable federal, state, municipal, or federal laws, rules, or ordinances, or other restrictions. You agree not to encumber or allow to exist any lien or security interest on the subject matter of these Terms, or to upload, post, email, transmit, or otherwise make available any unsolicited or unauthorised advertising, promotional materials, junk mail, spam mail, chain letters, or any other form of solicitation. You also agree not to make any representations or warranties on behalf of Hello Super APP in any way.

By using the Hello Super APP Platform, you consent and guarantee that you will not use abusive or disparaging language, post any objectionable content that is illegal, threatening, defamatory, or obscene, or communicate with our support agents via chat support or with the delivery partners.

This includes but is not limited to providing cooking instructions to restaurants. Hello Super APP retains the right to terminate the chat support service and/or prevent you from accessing and using the Hello Super APP Platform at any time, with or without prior notice, if you post offensive content or use abusive language.

Any content you upload will be governed by the laws of India and the nation in which it is used. It may also be disabled or the subject of legal investigation. Furthermore, Hello Super APP reserves the right to immediately block your access to and use of the Hello Super APP Platform, to remove any content or comments uploaded by you that is found to be in violation of the laws and regulations, these terms, or the Hello Super APP Platform's privacy policy. Hello Super APP also has the right to pursue any appropriate legal remedies that may be available to it under various statutes.

Customer feedback

If you share or send any ideas, suggestions, changes or documents regarding Hello Super APP's existing business ("Feedback"), you agree that

(i) your Feedback does not contain the confidential, secretive or proprietary information of third parties,
(ii) Hello Super APP is under no obligation of confidentiality concerning such Feedback, and shall be free to use the Feedback on an unrestricted basis
(iii) Hello Super APP may have already received similar Feedback from some other Customer or it may be under consideration or in development, and
(iv) By providing the Feedback, you grant us a binding, non-exclusive, royalty-free, perpetual, global license to use, modify, develop, publish, distribute and sublicense the Feedback, and you irrevocably waive, against Hello Super APP and its Customers any claims/assertions, whatsoever of any nature, about such Feedback.
Kindly limit your feedback to specific comments about Hello Super APP's current products or marketing methods. Do not submit any ideas that Hello Super APP is not allowed to accept or evaluate due to policy.

Despite the foregoing, neither Hello Super APP nor any of its staff will accept or take into consideration unsolicited ideas, including those for new or improved products or technologies, advertising campaigns, promotions, processes, materials, marketing strategies, or product names. Kindly refrain from sending Hello Super APP or any of its staff any unsolicited ideas, original creative artwork, suggestions, or other works (collectively, "Submissions") in any manner.

This policy aims to prevent misunderstandings or disagreements in the event that Hello Super APP's goods or marketing techniques appear to be copies of concepts that have been submitted to Hello Super APP. The following terms will apply to your Submissions regardless of what your letter states if you still give us your ideas in spite of our request that you not do so.

Terms of Idea Submission

You understand and agree that:

(1) Hello Super APP will automatically own your Submissions and their contents without paying you anything;

(2) Hello Super APP may use or redistribute the Submissions and their contents for any reason or in any manner;

(3) Hello Super APP is under no duty to review the Submission; and

(4) Hello Super APP is under no obligation to maintain the confidentiality of any Submissions.


Advertisements and promotions may be displayed on certain Services, which are funded in part by advertising revenue.

These adverts might be relevant to queries made via the Services, information stored on the Services, or other information. Without giving you prior notice, Hello Super APP reserves the right to alter the way, format, and scope of its advertising on the Services. You acknowledge that Hello Super APP may display such advertising on the Services in exchange for Hello Super APP providing you access to and usage of the Services. A portion of the website might include promotional content, advertising, or other materials that users or other parties have submitted to Hello Super APP. It is solely the responsibility of the entity submitting the information or material to make sure that everything submitted for inclusion on the Hello Super APP Platform or mobile apps conforms with applicable national and international legislation. All correspondence, business dealings, participation in promotions, and payments for related goods and services, as well as any other terms, conditions, warranties, or representations pertaining to such dealings, with advertisers other than Hello Super APP found on or through the Hello Super APP Platform and/or mobile apps, shall be between you and such advertiser. Any error or omission, inaccurate advertising material, loss or damage of any kind resulting from any such dealings, or from the presence of such other advertiser(s) on the Hello Super APP Platform and mobile application, shall not give rise to liability against Hello Super APP.

When it comes to any information about a charitable campaign ("Charitable Campaign") that is distributed to customers and/or shown on the Hello Super APP Platform, Hello Super APP is not involved in any way with the handling of the funds that are raised under the Charitable Campaign. Customers may choose to donate money by (a) making a payment on a third-party website, or (b) transferring funds to a third-party bank account. Regarding the authenticity, completeness, legality, or dependability of any information pertaining to the charitable campaign, Hello Super APP disclaims all responsibilities. For informational purposes only, information about the Charitable Campaign is displayed. Before taking any action in this regard, customers are urged to do their own independent verification.

Additional Terms and Conditions for Customers using the various services offered by Hello Super APP:


a. Hello Super APP offers food ordering and delivery services through contractual agreements it enters into on a principal-to-principal basis with restaurant partners (referred to as "Restaurant Partners") and stores (defined below) to list their menu items or products (described below) for food ordering and delivery by customers on the Hello Super APP Platform.

b. Through Hello Super APP, customers may make orders against restaurant partners and stores by accessing the menu items or products displayed on the platform.

c. By requesting to order food and drink or products from a Hello Super APP Platform store page or restaurant partner, you are giving Hello Super APP full, irreversible permission to place orders for food and drink or products on behalf of you with the restaurant partner(s) or store(s).

d. Delivery of an order you place through the Hello Super APP Platform may be handled by the Restaurant Partner or the Store you placed the order against directly, or Hello Super APP may arrange for delivery via a third party that may be able to assist you with delivery services ("Delivery Partners"). Hello Super APP is only serving as a go-between in these two situations—between you and the Delivery Partners, or, if applicable, between you and the Restaurant Partner or the Store.

e. When a Delivery Partner accepts your order, it will become a contract of service under the Consumer Protection Act of 2019 or any similar law, between you and the Delivery Partner. Hello Super APP is not a party to this contract under any applicable laws. It is made clear that Hello Super APP merely facilitates the delivery of food and drink or products that customers have ordered through the Hello Super APP Platform by putting them in contact with delivery partners, restaurant partners, or stores, as appropriate. Hello Super APP does not offer any delivery or logistics services.

f. In the event that Hello Super APP is assisting with the delivery of an order you have placed, Hello Super APP will not be held responsible for any actions or inactions on the part of the Delivery Partner, such as poor service, incorrect order delivery, excessive delivery delay, tampered order packages, etc.

g. If the Delivery Partner, Restaurant Partner, or Store decides to charge you a delivery fee for the delivery of your order, such charge will be indicated in the "Delivery Charges" section. You acknowledge that Hello Super APP has the right to collect the Delivery Charges for any delivery services that may have been supplied by the Restaurant Partner, the Store, or the Delivery Partner, on behalf of those parties. Delivery charges may differ from order to order and depend on a number of variables, such as the distance travelled, order amount, time of day, and restaurant partner or store. Hello Super APP will notify you of any delivery charges that might be applicable to you; but, delivery charges for your order will be your responsibility even if you are not aware of them.

h. When your order is delivered by the Delivery Partner, the Restaurant Partner, or the Store, you might also be charged a delivery surge fee. This fee is decided by a number of factors, such as the distance travelled, the time required, the demand for delivery, real-time traffic and weather analysis, seasonal peaks, or other parameters that may be determined periodically ("Delivery Surge"). You acknowledge that Hello Super APP is permitted to collect the Delivery Surge for any delivery service that the Restaurant Partner, the Store, or the Delivery Partner, as applicable, provides on behalf of those parties. Order to order variations in the Delivery Surge may be caused by a number of variables, including but not limited to the Restaurant Partner / Store, order value, distance travelled, and demand during peak hours. Hello Super APP will make a good faith effort to notify you of any delivery surcharges that may be applicable to you; nonetheless, you will still be liable for any delivery surges that are incurred for your order, even if you are aware of them.

i. In accordance with the relevant regulatory requirements and standard business procedures, Hello Super APP will provide documentation, such as an order summary and tax bills, regarding the order that You placed.

j. You promise not to discriminate against any Delivery Partner on the basis of Discrimination Characteristics (as defined below), in accordance with the expectation that you will respect the variety and dignity of Delivery Partners. Along with preventing and discouraging harassment (including sexual harassment) towards delivery partners, you are also expected to facilitate the establishment of a safe and courageous gig/platform work environment for the partners.

DiscriminationTerms and Conditions for Hello Super App,

These Terms and Conditions ("Terms", "Agreement") are an agreement between Hello Super App ("us", "we", or "our") and you ("User", "you", or "your"). This Agreement sets forth the general terms and conditions of your use of the Hello Super App website and any of its products or services (collectively, "Service").


Discrimination on the basis of race, community, religion, handicap, gender, sexual orientation, gender identity, age (to the extent that the relevant gig work permits it), genetic information, or any other legally protected status shall be deemed characteristics.

Food Ordering and Delivery with Restaurant Partners:

a. The restaurant partner provides all of the pricing stated on Hello Super APP Platform, including any applicable packaging or handling fees, at the time of publication. Hello Super APP displays the prices as received by the restaurant partner. Even while we make every effort to keep them current, the total cost that the restaurant partner will charge you, including any applicable handling and packing fees, could vary when the order is delivered. If there is a discrepancy between the price displayed on the Hello Super APP Platform and the price that the restaurant partner charges, the restaurant partner's price will be considered correct, with the exception of the Hello Super APP delivery charge.

b. On-Time Guarantee: This service could be offered for orders placed at specific restaurant partners. When enabled, Hello Super APP minimises order delays by assigning a suitable delivery partner who offers the service using its technological platform. This entails giving Delivery Partners first priority and ensuring that these orders are not combined with any other orders. You understand, however, that the Delivery Partner is providing these services at best effort, therefore in the event that your order does not arrive at your location by the On-Time Guarantee Time, you will be entitled to a 100% order value voucher. After the order is delivered to you, you have twenty-four (24) hours to claim the coupon; otherwise, your eligibility to get the coupon will expire. Additionally, the Coupon will be good for three (3) days after it is received. Notwithstanding anything set out herein above, you shall not be eligible to receive the Coupon if:

i. Failure to Meet the On-Time Promise Time is allocated for unanticipated events, such as strikes, natural catastrophes, or restaurant partners' incapacity to fulfil orders.

ii. You amend, modify, cancel, or change the order in any way. This includes, but is not limited to, adding or modifying the items ordered, having the order delivered to a different location than the one specified when the order was placed, and so on.

iii. You engage in activities meant to cause the order to be delayed, such as requesting that the delivery partner delay the order, becoming silent when someone calls, etc.

iv. According to Hello Super APP's typical order size, the order is a bulk order. Any reason can cause the order to be cancelled. Words capitalised in this clause shall mean the following: "On Time Guaranteed Time" refers to the Promised Delivery Time, beginning at the moment the restaurant partner accepts the order. The time it takes for the Delivery Partner to arrive within a 100-meter radius of your location or the first barrier point (such as a security guard or reception), whichever comes first, will be the actual delivery time. The term "coupon" refers to a one-time code that Hello Super APP generates for on-time guarantee delays, which may be used in accordance with the relevant guidelines.

General Terms and Conditions

a. Hello Super APP does not manufacture, sell, or distribute food and beverages or products; rather, it merely acts as an agent for the customers, placing orders against restaurant partners or stores on their behalf. This is done with the customers' unrestricted and irrevocable consent. Hello Super APP also helps customers and restaurant partners or stores buy and sell food and beverages or products in accordance with the terms of the agreement between the customers and restaurant partners or stores.

b. Hello Super APP disclaims all liability for any actions or inactions on the part of the Restaurant Partner/Store(s), including poor service, improper pricing, incomplete quantity, erroneous order delivery, incorrect quality, and length of time required to prepare or transport the order.

c. Hello Super APP will never be held liable for any warranty or guarantee related to the food and beverages or products sold to the customer; rather, the Restaurant Partner(s)/Store(s) will be entirely in charge of such matters.

d. Hello Super APP hereby clarifies to its Indian customers that the sellers/brand owners, vendors, restaurant partner(s)/store(s), importers or manufacturers of food products, products, or any pre-packaged goods, shall be solely liable for any violation of the applicable rules and regulations made thereunder. For the avoidance of doubt, Pre-Packed Goods are defined as food and drink items that are prepared for sale to customers and packed in any kind of package so that the contents cannot be altered without tampering with the package. They may also be defined as such from time to time under the Food Safety and Standards Act, 2006.

e. Please be aware that certain foods, drinks, and products may only be appropriate for a specific age range. Before placing your order, you should inspect the food and, if available, read its description. If the food and drink items or product you ordered do not satisfy your dietary needs or any other limitations, Hello Super APP will not be held responsible.

f. You will be asked for some information while placing an order, such as your delivery address and phone number, among other things. You promise to use extra caution while supplying this information, and at the time of placing an order, you attest to its accuracy and completeness. You agree to the terms and privacy policies of Hello Super APP by submitting these details.

g. Neither you nor anyone you designate may resale goods or food obtained through the Hello Super APP Platform.

h. When you place your order on the Hello Super APP Platform, the entire cost of the food you ordered—including delivery fees and other charges—will be shown. This figure may be rounded to the closest whole number. Customers ordering food or products through the Hello Super APP Platform are required to pay in full.

i. Any amount that Hello Super APP may charge you in addition to the order value will include all relevant taxes.

j. The delivery and takeaway times shown at the time of ordering are simply estimates that could change.

k. Only You may use the Personal Promo code in accordance with the rules and regulations that Hello Super APP may from time to time establish.

l. Cancellation and refund policy:
i. You understand that doing so will constitute a breach of your unrestricted and irrevocable authorization to Hello Super APP to place that order against the Restaurant Partners/Store(s) on your behalf. This includes
(1) your cancellation, or attempted or purported cancellation of an order, or
(2) cancellation due to reasons not attributable to Hello Super APP, such as in the event that you provide incorrect details, contact number, delivery address, etc., or that you were unresponsive, not reachable, or unavailable for the fulfilment of the services offered to you. Should you violate the authorization process, you will be responsible for compensating liquidated damages equal to the order value. You hereby give Hello Super APP permission to deduct or collect the amount owed as liquidated damages using any method it deems appropriate, including but not limited to deducting such amount from any payment made for your subsequent Order.

ii. For any number of reasons, including but not limited to technical difficulties, the unavailability of the item(s) ordered, or any other reason attributable to Hello Super APP, Restaurant Partner/Store, or Delivery Partner, Hello Super APP may occasionally be unable to accept your order or cancel it. In these circumstances, Hello Super APP won't charge you a cancellation fee.
purchase value, or any portion thereof, will be refunded to you if you cancel the purchase after payment has been charged and are entitled for a refund.

iii. Without the consent of the restaurant partner(s) or store(s), no replacement, refund, or other remedy will be given.

iv. If you have any complaints about the order—which include, but are not limited to, food spills, foreign objects in food, incorrect orders for food and drink, or products delivered—you must provide proof of the issue before a resolution can be offered.

v. If instructions sent with the order are not fulfilled in the way and to the extent that you intended, you will not be eligible for a refund. The Restaurant Partner / Store makes a good faith attempt to adhere to instructions.

vi. Unless you have been given a refund in the form of credits, all refunds must be processed in the same way that they were received. The amount of your refund will appear in your account in accordance with the guidelines of the individual banks.
